1. General

All rights, obligations, specials, orders and agreements that fall under these General Terms and Conditions, and under this condition, are applicable under Dutch Law and Jurisdiction. We urge you to read and understand these terms and conditions before you place your order. When the purchaser places an order at Bearhug Bunch,  also automatically accepts the stipulations set out in these General Terms and Conditions.

These terms and conditions may be updated and/or modified on occasions. Any changes made after you have placed an order will not affect that order unless we are required to make the change by law.

2. Orders


CAPACITY TO ENTER INTO CONTRACT

Every Customer of the Bearhug Bunch declares that he/she has the capacity to enter into a contract on the conditions described hereafter.
Bearhug Bunch reserves the right to refuse any order by a Customer with whom there exists, or which appears during processing, a dispute, in particular a dispute over payment.
 

ACCEPTANCE OF THE CONDITIONS BY THE CUSTOMER

The present Conditions can be read directly on www.bearhugbunch.com site. On simple request of the Customer, they can also be sent by electronic mail.
The act of the Customer's ticking the box "I accept the general sales conditions", before proceeding to secure payment, constitutes an irrevocable acceptance which can only be called into question in the extreme cases envisaged under the present general sales conditions under the paragraph "right of retraction". The Customer accepts by this act to having read and understood the present Conditions and to accept them.

 

PLACING OF AN ORDER

The individual Customer can place his order at Bearhug Bunch by Internet 24 hours a day, 7 days a week.
The ordering process is composed of 6 successive stages. Once product selection has been carried out, and the basket validated, the Customer must:
- clearly identify the products selected with the options of colors, sizes,… indicated on the www.bearhugbunch.com site;
- indicate the quantities requested;
- identify himself, either by entering his Customer number and password which are strictly personal to him, or by giving all the information usually requested for an inscription online;
- indicate clearly information necessary for the delivery. This relates in particular to the precise address of delivery, as well as possible restrictions of accessibility of the place of delivery (building, floor, door-codes, etc);
- indicate the selected mode of delivery;
- finally, indicate the selected mode of payment.
Once the mode of payment is selected, the Customer must proceed with payment of his order on the secure server, which will formalize the sales contract with Bearhug Bunch in a firm and final manner.
Every order implies acceptance of the prices and description of the products available for sale. Any dispute on this point will intervene within the framework of a possible exchange and guarantees mentioned below.
In every case, the supply online of the bankcard number and the final validation of the order by the Customer will constitute proof of the order and current liability for the sums for the products selected in the order. This validation constitutes signature and acceptance of all the operations carried out on the www.bearhugbunch.com site.
 

CONFIRMATION OF ORDER

An email is automatically sent to the customer in order to confirm the order provided that the email address indicated in the inscription form does not contain an error. The Customer must check the completeness and conformity of the information which he provides to Bearhug Bunch. The latter cannot be held responsible for possible errors of data-entry and the consequences in terms of delay or delivery error. In this context, all the expenses engaged for resending will be the responsibility of the Customer.
 

FOLLOWING OF THE ORDER

The Customer can at any moment check the status of his order by consulting the heading "My account" on the www.bearhugbunch.com site. This following of the order makes it possible for the Customer to know the stage of processing of his order, but also the stage of sending or delivery of his parcels. This last following of delivery is carried out with the deliverers' Internet interface. Bearhug Bunch thus cannot be held accountable for the unavailability or errors that may affect the information supplied by its transporters. Bearhug Bunch endeavors nevertheless to make this information as clear as possible and to make the transport as reliable as possible with its transporters. The Customer can at any moment contact Bearhug Bunch in order to be informed of the stage of his order.
 

PROOF OF THE ORDER

The computerized registrations, preserved in the information processing systems of Bearhug Bunch company under reasonable conditions of security, will be regarded as the evidence of the communications, the orders and the payments that have taken place between the parties.
The filing of the purchase orders and the invoices is carried out on a reliable and durable support which can be produced as proof.

 

Bearhug Bunch strives to keep the stock levels in our webshop correct. However, it is possible that a certain product is no longer available, in which case we will contact the consumer as soon as possible. A product must be delivered to the consumer within 30 days of the order placement. If Bearhug Bunch fails to comply with this, the consumer may immediately break the order contract. This is not possible, however, if the parties involved have previously agreed to a different delivery term.

3. Prices and Payment

All prices indicated on www.bearhugbunch.com are in Euro’s and include value added tax. Consumers are able to make payments electronically to Bearhug Bunch in the following forms:

Credit Card (VISA, Master Card & American Express)

SEPA Bank Transfer

Giropay (DE)

 

The differing payment methods are indicated on the website under the title “Payment” in page "Order and Delivery". Shipment of the order will take place once Bearhug Bunch has received payment for the order. Bearhug Bunch will add the shipping costs to the invoice of the order. More information concerning the shipping costs can be found under the title: “Shipping” in page "Order and Delivery".

4. Delivery

The delivery time is indicative and is therefore not guaranteed. However, the final delivery time will not exceed more than one week of the indicated delivery time, except cases of 'force majeure'. The order will be processed and shipped within five working days of receiving payment. Bearhug Bunch cannot be held responsible if the post is unable to deliver the order to the consumer on time.

5. Returns

Bearhug Bunch will gladly accept returns. Items must be returned within 14 days from the date of delivery. Please return all items in its original packaging and with the original hangtags. Bearhug Bunch will not accept any items that have been washed, worn, stained, damaged or altered in any way. Items that do not meet these conditions will be returned to the sender, minus the shipping costs for returning the items.

 

All returns should be accompanied by a note with the order number and reason of return. Unidentifiable returns may not be possible to refund. Returns will be handled within 5 working days from receiving the return. The returned items will be refunded to the same card or account that they were paid from. Shipping costs will not be refunded.

Bearhug Bunch recommends sending your return with traceable post, so please keep your track & trace receipt to track your order. We have no information on your return while it is on its way to us. Shipping costs for returning are the responsibility of the customer. Lost packages will not be refunded.

If Bearhug Bunch sent the wrong item or the item appears to be defect upon arrival, notify us on letshug@bearhugbunch.com within 14 days from receiving the item(s). We will refund the return shipping costs and send you the new and correct items as soon as possible, if stock is available.

 

6. Transfer of Ownership

Ownership of merchandise will not be transferred until the associated obligations of purchaser have been fulfilled. At the point of transfer of ownership, which is at the point of delivery of the articles, product liability is transferred to the purchaser.

7. Queries/ Complaints

In the case of queries or complaints concerning any of our products or procedures, please inform us by email at letshug@bearhugbunch.com. You will receive a reply within three working days.

9. Privacy


It is crucial for Bearhug Bunch that all of the consumer’s personal information is treated with the absolute care and security. Bearhug Bunch will not provide the consumer’s personal information to third parties, except when the information is required for the delivery of the order. When making an order, Bearhug Bunch requires the consumer’s name, invoice and delivery addresses, and payment details so that an order can be processed. The payment details will only be used to conclude the payment process. If the consumer subscribes to our newsletter or RSS, their personal details will be used to keep them informed of changes to our assortment, special offers, website improvements and other relevant information pertaining to Bearhug Bunch. Records of website visits are kept for statistical purposes. Information concerning the amount of visitors and visitor frequency to our website will be used for internal research and website improvement. However, this general information is anonymous and cannot be traced back to the individual visitor.

10. Liability

All articles in the assortment of Bearhug Bunch have been produced with the extreme care. Bearhug Bunch cannot assume any liability for damages in any form whatsoever, either physical, material or immaterial, that can be caused by malfunctioning or ill use of the articles sold by Bearhug Bunch and/ or materials or accessories becoming undone.

The content of the website has been compiled with the greatest care. However, Bearhug Bunch cannot preclude the possibility of any error or incompleteness in the information on this website. Bearhug Bunch cannot assume any liability for the consequences of incorrect or incomplete information on the website. Bearhug Bunch cannot be held responsible for any typing or misprinting errors that could communicate an incorrect selling price. In that case Bearhug Bunch will adjust the price as soon as possible. The actual color of the products can differ from the colors shown on the computer screens. Bearhug Bunch cannot be held responsible for variations in colours as a consequence of the quality of the computer screens. The position and size of the actual applications, prints and/ or embroideries on the clothes can differ slightly from the display on the website. Bearhug Bunch cannot be held responsible for this. Certain links on the website can give access to websites and information that is being exploited and maintained by third parties. Bearhug Bunch does not control these sites and it not responsible for the content of these sites.

11. Force Majeure

Despite any other established legal rights, Bearhug Bunch is entitled , at its own choice, in case of Force Majeur, to cancel your order, or cancel the purchase agreement without legal intervention, by informing the client in writing. Client is not entitled to any damages, unless given the circumstances this would be unacceptable according to measures of reason and fairness.

12. Copyright

All information on Bearhug Bunch websites is protected by copyright. It is illegal to copy, use or distribute any information from Bearhug Bunch's website without first acquiring written permission. Visitors and users of Bearhug Bunch's website may not claim any rights pertaining to the information on the website. None of the text or graphics from Bearhug Bunch's websites may be partially or wholly copied or publicly used for printing, photocopying, faxing, overtyping, in an electronic database, or for any other reproduction purposes.

13. Acceptance of General Conditions

All website users are required to be aware of, and to agree with, all of the above General Conditions. By placing an order with Bearhug Bunch, the consumer automatically agrees to all of our General Conditions. Bearhug Bunch's client’s details are automatically stored in our client list and will receive our newsletter.
